STORYLINE:
Peru's Congress on Tuesday overturned a law that President Alan Garcia had backed which would have set limits on prosecuting human rights abuses.
Garcia had originally supported the idea but backed away from the law after acclaimed Peruvian novelist Mario Vargas Llosa criticised the move.
Critics say the Decree 1097 would free human rights violators from prison. The measure sent to Congress would establish a statute of limitations on human rights violations committed before 2003. And it would close cases under investigation for too long.
On Monday, Vargas Llosa sent a letter to Garcia in which he refused to lead a commission charged with building a museum to remember the years of political violence.
The author called the decree a "barely disguised amnesty."
The vote was overwhelming.
"The final results: 90 votes in favour, one against. Zero abstentions. Approved in the first vote," said Congress President Cesar Zumaeta.
Peru's war with Maoist guerrillas killed almost 70-thousand people between 1980 and 2000, according to the Truth and Reconciliation Commission.
The violence waned following Shining Path founder Abimael Guzman's capture in 1992, but isolated guerrilla bands are growing with the drug trade.
Critics worry the new process would have freed figures like the now-jailed intelligence chief Vladimiro Montesinos.
He is serving a 15-year prison sentence and was the behind-the-scenes power broker during former President Alberto Fujimori's 10-year government, which fell in 2000 amid a corruption scandal.
